Terms and Conditions

AusTV, located at AusTV, GPO Box 2629, Canberra ACT 2601, Australia(referred to as “AusTV”, “we”, or “us”), has developed and operates the AusTV application for iOS and Android devices. AusTV can be downloaded at https://austv.io, through the Apple App Store, and through Google Play.

Before using AusTV, please review these Terms and Conditions. AusTV is an electronic programme guide (EPG) that provides information about Australian free-to-air television programmes based on your selected Australian region. AusTV is operated from Australia and is designed for Australian TV viewers only. If you have any questions about these terms, please contact us at hello@austv.io.

Scope and application

These Terms and Conditions apply to all services, products, features, and content created or provided by AusTV. They apply to both registered and unregistered users of AusTV products and services.

Eligibility

AusTV is intended for users aged 18 and over. Users under the age of 18 may only use AusTV with the consent and supervision of a parent or legal guardian. By using AusTV, you represent that you meet these eligibility requirements.

General use of AusTV

The AusTV iOS and Android apps can be used with or without a registered AusTV account. Creating an AusTV account is free and allows eligible settings and app data to be synced between devices.

You are responsible for maintaining the confidentiality of your password and account access. Do not share your password or allow third parties to access your account. If you suspect your password has been lost, misused, or used without authorisation, please contact us at hello@austv.io.

AusTV may periodically check and clean up inactive installations, sessions, and device related technical records after a period of inactivity. This helps keep the service reliable and reduces unnecessary stored data.

Data backup and cloud sync

Registered user data may be backed up to cloud infrastructure and made available across AusTV platforms when you sign in. To protect data during synchronisation and backup, AusTV uses trusted cloud infrastructure and SSL/TLS secured communication between the app, website, and AusTV services.

Rules of use

You must comply with all applicable laws while using AusTV. You must not enter, transmit, or disseminate content that violates any law, infringes third-party rights, compromises the security of AusTV, or interferes with other users' ability to use the service.

You are responsible for content and information you provide through AusTV. AusTV may suspend or terminate access, restrict account activity, or remove unlawful or inappropriate content where reasonably necessary to protect the service, other users, or third parties. If you become aware of illegal or unauthorised use of AusTV, please report it to hello@austv.io.

Australian TV listing data

TV listing data displayed within AusTV is sourced from IceTV and other related data providers. Listing data is provided for personal, non-commercial use only. You must not commercially exploit, redistribute, sublicense, scrape, or otherwise make AusTV listing data available to any third party.

Listing data is provided on an “as is” and “as available” basis. AusTV does not guarantee the accuracy, completeness, timeliness, availability, images, titles, descriptions, start times, end times, or other EPG-related information displayed in the app. You use and rely on TV listing data at your own risk.

AusTV Plus, subscriptions, and in-app purchases

AusTV is available for free download. To access premium features or remove in-app advertising, you may choose to purchase AusTV Plus. AusTV Plus may be available as a one-time in-app purchase, monthly subscription, quarterly subscription, yearly subscription, or other purchase option shown in the app store purchase flow.

Purchase options, features, prices, trial periods, and renewal periods are shown before purchase and may change from time to time. Any purchase is processed by the Apple App Store or Google Play, depending on the platform used.

Apple App Store subscriptions

Auto-renewable subscriptions purchased through the Apple App Store are charged to your Apple account when you confirm purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple account may be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel Apple subscriptions in your Apple account settings after purchase. Any unused portion of a free trial period, if offered, may be forfeited when you purchase a subscription, subject to Apple's applicable terms.

Google Play subscriptions

Auto-renewable subscriptions purchased through Google Play are charged to your Google Play account when you confirm purchase. Subscriptions automatically renew according to the subscription terms unless you cancel through Google Play before the next renewal.

You can manage or cancel Google Play subscriptions in your Google Play account settings after purchase. Uninstalling the AusTV app does not cancel a Google Play subscription or an Apple App Store subscription.

Refunds and consumer guarantees

Refund requests for purchases made through the Apple App Store or Google Play are generally handled by the relevant app store. AusTV does not directly process app store payments and may not be able to issue refunds for those purchases.

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, remedy, or protection that cannot be excluded under the Australian Consumer Law or other applicable law.

In-app advertisements

The free version of AusTV is supported by in-app advertising, which may include banner advertisements, interstitial advertisements, native advertisements, and sponsored content. Eligible AusTV Plus purchases or subscriptions may remove in-app advertising while the purchase or subscription remains valid.

Intellectual property

AusTV products, services, design, features, branding, software, and content are owned by AusTV or its licensors and are protected by copyright, trade mark, and other intellectual property laws. You may use AusTV only as permitted by these Terms and Conditions and applicable app store terms.

Links to third-party services

AusTV's website and mobile apps may contain links to third-party sites or services that are not owned or controlled by AusTV. AusTV is not responsible for the content, privacy policies, terms, or practices of third-party sites or services. You should review the terms and privacy policy of any third-party service you use.

Disclaimer of warranties

To the maximum extent permitted by law, AusTV is provided on an “as is” and “as available” basis. AusTV does not warrant that the service will be uninterrupted, error-free, or free of harmful components. AusTV may modify, suspend, or discontinue the service or any part of it at any time.

Limitation of liability

To the maximum extent permitted by law, AusTV, its operators, and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or opportunity, arising out of or in connection with your use of AusTV or inability to use AusTV.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including rights under the Australian Consumer Law.

Indemnification

You agree to defend, indemnify, and hold harmless AusTV, its operators, and its affiliates from and against claims, losses, liabilities, costs, and expenses arising out of or related to your breach of these Terms and Conditions, misuse of AusTV, or violation of any applicable law or third-party rights.

Termination

You may stop using AusTV at any time. AusTV may suspend, restrict, or terminate access to the service where reasonably necessary, including where you breach these Terms and Conditions, misuse the service, or create risk for AusTV, other users, or third parties.

Changes to these Terms and Conditions

AusTV reserves the right to modify these Terms and Conditions at any time. The date of the latest revision will be indicated at the bottom of this document. You are responsible for regularly reviewing these terms to stay informed of any changes.

Governing law

These Terms and Conditions are governed by and construed in accordance with the laws of the Australian Capital Territory, Australia. Any disputes arising under or in connection with these terms are subject to the jurisdiction of the courts of the Australian Capital Territory, without prejudice to any rights you may have under applicable Australian consumer protection laws.

Your acceptance of these terms

By accessing or using AusTV's services or products, including visiting the website, downloading or using the AusTV iOS or Android app, or registering as a user, you agree to be bound by these Terms and Conditions and the Privacy Policy.
